Re: Legality of AAWC’s actions under its Noise Compatibility Program and Airport Improvement Program (AIP), for Noise Mitigation

Dear Bob:

You have requested our opinion concerning the legality of actions taken by the Airport Authority of Washoe County (AAWC) under its Noise Compatibility Program (NCP) and the Airport Improvement Program (AIP) for Noise Mitigation. After having reviewed the historical background relating to these Programs, interviewing your staff concerning its actions as well as studying the correspondence and information provided by the Federal Aviation Administriation (FAA) and applying the applicable laws and regulations, it is our opinion that the Airport has complied with all aspects of the aw and has taken no illegal actions under these Programs. This opinion is based on the following:

It is therefore, our opinion, that the Airport has violated no applicable law in its past and current actions under its Noise Compatibility Study and Program or its acquisisiton of land through the Airport Improvement Program for Noise Mitigation.
